Army GOMOR Rebuttal Lawyer for Officer Elimination and NCO QMP Risk

A permanently filed GOMOR does far more than damage an Army Officer's promotion file. Permanent filing automatically leads to the HRC process for referral to an elimination action—a show-cause proceeding requiring the Officer to defend continued service. For an NCO, permanent filing creates the risk of QMP review and involuntary separation.

The rebuttal is the opportunity to fight the allegations, the filing decision, and the career consequences before the command's version becomes the permanent record.

Quick answer: A GOMOR rebuttal should not be a generic apology, a fill-in-the-blank memorandum, or a stack of unfocused character letters. It should determine what the evidence actually proves, identify what can still change the filing authority's decision, develop the facts and supporting material that matter in this case, and confront the follow-on career action: automatic HRC elimination referral for an Officer and QMP risk for an NCO.

Why the filing decision matters

For an Officer, permanent filing automatically starts the next case.

The filing decision is not just about where one memorandum is stored. For an Officer, permanent filing automatically leads to the HRC process for referral to an elimination action. For an NCO, it creates the risk of a QMP action that can end the NCO's Army career.

Army Officers

Permanent filing automatically triggers the HRC elimination-referral process.

When a GOMOR is permanently filed in an Army Officer's Army Military Human Resource Record, HRC's process generates a referral memorandum requiring the Officer to show cause for retention. The Officer does not have to commit new misconduct, fail promotion, or wait for the local command to start a separate action. The permanent filing itself starts the HRC referral process.

The referral memorandum cites:

  • the applicable provision of AR 600-8-24 for elimination based on permanently filed derogatory information;
  • the applicable misconduct provision based on the allegation underlying the GOMOR; and
  • often, conduct unbecoming an Officer as an additional basis.

The GOMOR rebuttal is the first important defense document in the later elimination case. A well-built response challenges the allegation, gives the filing authority a reason to avoid permanent filing, and preserves the strongest position when the HRC referral process begins.

Permanent filing requires the Officer to defend continued service in a show-cause proceeding.

Army NCOs

A permanent GOMOR can lead to QMP and involuntary separation.

For Regular Army and AGR NCOs in the grades considered by the Qualitative Management Program, a GOMOR permanently filed for conduct in the current grade is material that can place the NCO before a QMP board. The board can deny continued service, which can result in involuntary separation.

The QMP board reviews the NCO's record and any matters submitted for retention. That makes the original GOMOR response important for two reasons: it may help prevent permanent filing in the first place, and it may shape how the allegations and the NCO's response appear when later decision-makers review the record.

A GOMOR does not have to be a criminal conviction to put an NCO's career at risk.

Built for your case

A serious GOMOR rebuttal is built for the facts of this case.

The goal is not to make the packet thick. The goal is to make every part of it serve a reasoned strategy.

I do not handle GOMOR cases by giving a client a generic template, vague instructions to gather letters, or a sample response written for someone else.

I begin with a different question: Under the facts, evidence, deadline, command posture, and career stakes in this particular case, what can we do to create the strongest available chance of a favorable result?

The answer is different in every case. Some cases require a direct factual challenge. Some require reconstruction of an incomplete investigation. Some require careful accountability without conceding conduct the evidence does not establish. Some turn on why permanent filing would be unnecessary or disproportionate. Many require a combination of factual evidence, context, performance history, rehabilitation, and targeted support from the right people.

Case-specific representation

What I may do in a GOMOR case

01

Review the entire packet

I review the GOMOR, referral documents, suspense, investigation, exhibits, witness statements, digital communications, prior responses, and the evidence supporting the reprimand. I look for missing material, contradictions, unsupported conclusions, credibility problems, procedural issues, and ignored facts.

02

Define the best available outcome

The response may seek withdrawal and destruction, correction or narrowing of inaccurate language, local filing, or another result the record supports. The request should be ambitious, credible, and tied to the actual decision the filing authority can make.

03

Develop missing evidence

That can include witness statements, messages, photographs, videos, medical or scientific records, timelines, policies, training records, evaluations, awards, deployment history, and other documents that test the allegation or explain the full context.

04

Build support letters for a purpose

I do not simply tell a client to “get character letters.” We identify who can address a specific issue, why that person's knowledge matters, and what the filing authority needs to understand. Generic praise is not a substitute for relevant information.

05

Draft around the evidence and decision

The final response should be clear, disciplined, and easy for a senior decision-maker to follow. It should confront difficult facts, avoid unnecessary admissions, justify the requested outcome, and organize the enclosures so the important proof is not buried.

06

Protect against what comes next

The response may later be read by HRC, a QMP board, a Board of Inquiry, a separation board, a promotion-review authority, or an Army records-correction board. I draft with that reality in mind.

Direct attorney access

You hire me. You work with me.

When you retain me for a GOMOR rebuttal, you work directly with me—not through a case manager, a rotating team, or a junior lawyer who has been handed the file.

You receive my direct cell phone number for calls and texts, along with my direct email address. That access matters in a short-suspense case. A new document, witness, command recommendation, or deadline issue can change the strategy. Direct communication helps us make decisions while there is still time to act on them.

Client-reported GOMOR outcome

Published client review

Reprimand withdrawn after the response was rebuilt around documents and facts

The client reported arriving with an angry first draft. After the facts were separated from assumptions and the response was supported with documents, the reprimand was withdrawn.

This description summarizes a published client review. Prior results do not guarantee future outcomes; every matter depends on its own facts, evidence, command posture, deadline, and applicable law.

This service may fit when:

GOMOR rebuttal questions

Answers before you respond.

What is a GOMOR rebuttal?

A GOMOR rebuttal is the Soldier's written response before the filing authority decides whether to withdraw the reprimand, file it locally when authorized, or place it in the performance portion of the AMHRR. It can challenge the allegation, explain missing context, present additional evidence, address mitigation, and show why the requested filing decision is justified.

How quickly should I contact a GOMOR lawyer?

As soon as you receive the packet. The controlling suspense is the date in the referral documents, and the useful work includes much more than writing. The lawyer may need time to review an investigation, identify missing evidence, contact witnesses, request records, develop focused support, and seek an extension when justified.

Does a permanently filed GOMOR automatically trigger the Officer-elimination process?

Yes. When a GOMOR is permanently filed in an Army Officer's AMHRR, it automatically leads to the HRC process for referral to an elimination action. HRC generates a referral memorandum requiring the Officer to show cause for retention. The memorandum cites the applicable AR 600-8-24 basis for elimination based on permanently filed derogatory information and the applicable misconduct provision based on the allegation underlying the GOMOR. It often includes conduct unbecoming as an additional basis.

Can a GOMOR lead to QMP for an NCO?

Yes. For Regular Army and AGR NCOs in the grades covered by QMP, a permanently filed GOMOR based on conduct in the current grade is QMP-triggering material. A QMP board can deny continued service and cause involuntary separation.

What should go into a strong GOMOR rebuttal?

The contents depend on the case. A strong response may include a focused factual analysis, additional witness statements, digital or documentary evidence, a timeline, relevant policies, medical or scientific evidence, evaluations, awards, rehabilitation evidence, and targeted letters from people with useful firsthand knowledge. Every enclosure should have a reason for being there.

Should I use a GOMOR rebuttal template?

A template may show memorandum formatting, but it cannot decide the theory of your case, test the evidence, identify the right witnesses, account for later elimination or QMP risk, or determine which admissions could cause harm. The substance must be built around the actual allegation, evidence, filing rules, and career consequences in your case.

Should I admit responsibility and ask for local filing?

Not automatically. Accountability can be persuasive when it is accurate and strategically sound. An unnecessary or overbroad admission can also be used in a later elimination, QMP, separation, or other adverse action. The response should match what the evidence establishes and the outcome the case can credibly support.

Is local filing available in every GOMOR case?

No. The governing filing rule and the conduct alleged must be reviewed. Certain sex-related offenses require filing in the performance portion of the AMHRR. In other cases, local filing may be available and can be requested when the evidence and circumstances support it.

What if the GOMOR has already been permanently filed?

A separate process may be available to seek removal or transfer through the Department of the Army Suitability Evaluation Board. The burden and evidence are different from the original rebuttal. Learn about GOMOR removal and appeal representation.

You will work directly with Blake Kamoroff. Clients receive his direct cell phone number for calls and texts and communicate with him by direct email. Blake personally reviews the evidence, develops the strategy, and drafts the response within the agreed scope of representation.
