Article 15 is still an evidence problem.
Soldiers sometimes assume the commander has already made up their mind, so evidence does not matter. Evidence still matters because it affects whether to accept Article 15, what to submit, what punishment to argue against, and whether follow-on action is likely.
The election decision is strategic.
Accepting Article 15 and demanding trial both carry risk. The decision should be based on the evidence, likely charges, witnesses, command posture, and the Soldier’s career circumstances.
Mitigation is not the same as defense.
Defense challenges the allegation. Extenuation explains context. Mitigation explains why punishment should be reduced. Mixing them carelessly can weaken all three.
